These Terms and Conditions of Entry relate to the POWERADE POWERSCORE events (the "POWERSCORE").
The Organisers of the POWERSCORE are Maverick Marketing and Communications Pty Ltd (Maverick) and Coca-Cola South Pacific Pty Ltd (CCSP)
HOW TO ENTER
The POWERSCORE starts in Australia at 06:00 on 21st March 2017 and closes at 11:59:59pm on 30th November 2017 (Entry Period).
Registrations for the POWERSCORE QLD Qualifier Events open from 06.00 of 10th April 2017 and close at 11:59pm on Sunday 28th May 2017, 2 weeks prior to the POWERSCORE QLD Finals Event on 11th June 2017.
Registrations for the POWERSCORE NSW Qualifier Events will run from June to August and will close 2 weeks prior to the NSW Finals Event in September 2017 (Registration Period).
All dates may be subject to change at the discretion of the Organisers. Any changes to dates or locations will be communicated through the POWERADE website www.powerade.com.au
Registrations received before the opening or after the close of the Registration Period will not be accepted. Powerscores for participation in the competition completed before the opening or after the close of the Registration Period will not be recorded.
You can register online at www.powerade.com.au and
register your name, date of birth and contact details online during
the Registration Period.
You must accept the terms and conditions during registration which includes a declaration of fitness to participate in the POWERSCORE competition, and a release of the Organiser from all liability in connection with the POWERSCORE to the maximum extent permitted by law.
Any cost associated with accessing the POWERSCORE website is the registrant's responsibility and is dependent on the internet service provider or telecommunications provider used.
REGISTRATION & ELIGABILITY
Registration for the POWERSCORE competition requires acceptance of these Terms of Participation. All elements of the registration process, including the declaration of fitness to participate and the release, form part of these Terms of Participation.
You can enter test results for the POWERSCORE as many times as you wish during the registration period through the 'at home' qualification method online. Once successfully registered, you are a POWERSCORE Participant.
POWERSCORE Participants who have registered at an official POWERSCORE Qualifier Event in QLD, are only eligible for the POWERSCORE QLD FINAL event.
QLD participants who entered at an official POWERSCORE Qualifying event in QLD, are not eligible to qualify for the POWERSCORE NSW FINAL, unless they attend at POWERSCORE Qualifying event in NSW.
POWERSCORE Participants who have registered at an official POWERSCORE Qualifier Event in NSW, are only eligible for the POWERSCORE NSW FINAL event.
Any participant that enters via the ‘at home’ qualification method online, is eligible for the upcoming POWERSCORE FINAL event in QLD or NSW.
The POWERSCORE competition is only open to "Eligible Registrants", being individuals who:
are 16 years or older at the start of the Registration Period;
are residents of Australia at the start of the Registration Period;
At that close of registration for the POWERSCORE QLD FINAL event, the top 250 POWERSCORE athletes who entered at an official POWERSCORE Qualifying event in QLD will be invited to attend the POWERSCORE QLD Final. An additional 50 athletes who entered via the 'at home' qualification method online will also be invited to attend the POWERSCORE QLD Final.
At that close of registration for the POWERSCORE NSW Final event, the top 250 POWERSCORE athletes who entered at an official POWERSCORE Qualifying event in NSW will be invited to attend the POWERSCORE NSW Final. An additional 50 athletes who entered via the 'at home' qualification method online will also be invited to attend the POWERSCORE NSW Final.
If a qualified participant declines an invitation to either the POWERSCORE QLD FINAL or the POWERSCORE NSW FINAL events, an invitation will be extended to the next participant from the list of participants who attended an official POWERSCORE Qualifying event in the respective state of the POWERSCORE Final event.
Any participant that attends the POWERSCORE QLD FINAL event is ineligible to qualify and participate at the POWERSCORE NSW FINAL event.
A participant must complete all four POWERSCORE tests to receive a POWERSCORE and be eligible for the POWERSCORE FINAL events in QLD or NSW.
SAFETY AND ETIQUETTE DURING THE POWERSCORE COMPETITION
All POWERSCORE participants are expected to conduct themselves in a professional courteous and in an honest manner during their participation in the POWERSCORE competition. Anyone violating this rule of conduct may be disqualified from the competition at the Organiser's discretion.
While the Organiser has taken every reasonable measure to ensure POWERSCORE Participants' safety, as a POWERSCORE Participant, you are responsible for your own safety and enter the POWERSCORE competition and training entirely at your own risk.
POWERSCORE participants are responsible for and assume liability for any and all costs or expenses incurred as a result of training for and/or participation in the POWERSCORE, including but not limited to medical services, ambulance transport, hospital stays, physician and pharmaceutical goods and services.
All POWERSCORE Participant scores will be entered into the POWERSCORE website and added to the POWERSCORE leader board.
Official qualifying test scores and times from POWERSCORE Qualifying events will be recorded by official POWERSCORE staff members.
The four POWERSCORE tests are;
Speed - 40m sprint test
Agility - 20m agility test
Power - Vertical leap test
Endurance - Beep test
POWERSCORE Participants qualifying test scores and times from the 'at home' qualification method online are to be recorded by themselves. It is the expectation of the competition organiser that this information is entered in an honest manner.
If a POWERSCORE Participant's individual test scores for each test is better than the benchmark score, the Organiser reserves the right to request the POWERSCORE Participant verifies their test scores at a POWERSCORE Qualifying event. If the POWERSCORE Participant cannot adequately verify their test scores (in the Organiser's sole discretion) the Organiser reserves the right to disqualify the POWERSCORE Participant and remove their results from the Leaderboard.
The Organiser reserves the right, at any time, to verify the validity of all registrations and Eligible Registrants (including a registrant's identity, age and city/town of residence) and to disqualify any entrant or POWERSCORE Participant who submits a registration that is not in accordance with these Terms of Participation or who tampers with the registration process. Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible registrations will be deemed invalid.
The Organiser's decision is final and no correspondence will be entered into.
Entering details online is not proof of receipt of the registration. When entering online the POWERSCORE Participant will receive confirmation of the registration via email. The Organiser accepts no responsibility for any messages that are lost or delayed, or which are unable to be sent due to lack of network coverage, operator or network error, or for any other reason beyond its control.
If for any reason the administration, security, fairness, integrity, conduct or operation of this POWERSCORE competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Organiser (including but not limited to act of God; any act of a public enemy, war, civil unrest, or act of military authority; fire, flood, earthquake, landslide, or other elements of nature; any strike, lockout or other labour dispute; any act of a third party engaged in terrorist activity or sabotage; vandalism; tampering; power failures; computer bugs or viruses; unauthorised intervention; fraud or technical failures), the Organiser reserves the right, in its sole discretion, to the fullest extent permitted by law:
to disqualify any entrant; and/or
as appropriate, to modify, suspend, terminate or cancel; or recommence this POWERSCORE events.
Any person suspected of cheating, misrepresenting their registration, or manipulating their results, in the opinion of the Organiser, through the manipulation of entry to the website or fraudulently falsifying data or acting in any way fraudulently, in the opinion of the Organiser, may be removed from this POWERSCORE and damages may be sought.
The Organiser takes no responsibility for lost, damaged, misdirected, late or illegible entries, incorrect or inaccurate transcription of entry information, for system failures at the handling house, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, computer equipment, software or any other error or malfunction. Neither can the Organiser be held responsible for the failure to fulfil the obligations of any of the third parties involved in the POWERSCORE, although the Organiser will always endeavour to minimise the effect to the participant of any such failure.
Except for any liability that cannot be excluded by law, the Organiser (including its directors, shareholders, officers, employees, contractors, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies) its related companies and Coca-Cola South Pacific (CCSP) Limited (the Related Parties) exclude all liability (including negligence), for any personal injury or death, or loss (including any damage, claim, injury, cost or expense); whether direct, indirect, special or consequential, arising in any way out of the POWERSCORE competition, including, but not limited to, where attributable to any of the following:
any negligence of a Related Party;
any technical difficulties or equipment malfunction (whether or not under the Organiser's control);
any theft, unauthorised access or third party interference;
any entry, registration or Registration Pack, claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Organiser) due to any reason beyond the reasonable control of the Organiser;
any tax liability incurred by a POWERSCORE Participant, winner or Eligible Entrant; or
use of a Registration Pack.
All entries remain the property of the Organiser.
POWERSCORE Participants consent to the Organiser using his/her name, age band, state of residence, authorised statement, image and/or voice, results/scores from participating in the POWERSCORE, on the POWERSCORE website, and in public in any media for an unlimited period without remuneration for the purposes of administering the POWERSCORE, and promoting the POWERSCORE and any products manufactured, imported, distributed and/or marketed by the Organiser. Eligible Entrants and POWERSCORE Participants consent to the Organiser using his/her name, city/town of residence, authorised statement, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this POWERSCORE (including any outcome), and promoting any products manufactured, imported, distributed and/or marketed by the Organiser.
The Organiser collects POWERSCORE Participants' and Eligible
Entrants' personal information in order to conduct this
competition. If the information requested is not provided, the
POWERSCORE Participant and Eligible Entrant may not participate in
this POWERSCORE. All personal information provided by Eligible
Entrants and POWERSCORE Participants will be held for the Organiser
at Satellite Media, Level 3, 65-73 Parnell Rise, Parnell, Auckland,
1052, New Zealand or such other place as is notified to the
POWERSCORE Participant or Eligible Entrant on request.
The personal information of Eligible Entrants and POWERSCORE Participants may also be provided to others (including organisations outside of New Zealand) assisting in the conduct of this POWERSCORE competition, including the POWERSCORE's administrator, agencies and event coordinators, and to authorities that regulate the competition. Eligible Entrants and POWERSCORE Participants acknowledge that they provide their consent for this to occur by participating in the POWERSCORE. Under the Privacy Act 1993, Eligible Entrants have the right to access and correct their personal information. A request to access, update or correct any information should be directed to the Organiser at the address set out below. The Organiser will destroy all details once the POWERSCORE Period expires, all Prizes have been claimed and this POWERSCORE closes.
The Organiser reserves its right to modify these Terms of Participation at any time for any reason. You agree that you will be bound by such changes and that you will not hold the Organiser liable for any losses resulting from any such changes.
These Terms of Participation are governed by, construed in accordance with, the laws of Australia and the parties agree to submit to the exclusive jurisdiction of the Courts of Australia.

CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE Organiser RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
